Del Monte Pushes For Dismissal Of Torture CaseNathan Hale of Law360 ($$) writes that last Friday, Fresh Del Monte Products argued that the Eleventh Circuit Court of Appeals should affirm the dismissal of a claim brought by union leaders claiming they were tortured in Guatemala.  In pertinent part, the company contended that the case should be dismissed because of the plaintiffs’ own forum-selection strategy.  The plaintiffs, not surprisingly, disagreed. 

“The fundamental assumption of forum non conveniens law is there must be an available forum,” [plaintiffs’ counsel] said.

The suit arose during a labor dispute in 1999, when a Guatemalan union was negotiating a new bargaining agreement.  A Del Monte subsidiary fired almost 1,000 workers during the talks, then allegedly hired a group of thugs to beat up the union leaders.  We will keep you posted on the 11th Circuit’s decision.

Board Charges Filed Against Kellogg’sSteve Payne at Labor Notes reports that Kelloggs’ and BCTGM are in the midst of a protracted lockout that began during contract negotiations in October of 2013.  Recently, BCTGM filed unfair labor practice charges with the National Labor Relations Board against the cereal magnate, contending that Kellogg’s attempted to unilaterally impose new contract terms and conditions on union members.  Union members have also been holding pickets for months, upset that Kellogg’s has brought in replacement workers to maintain production.  We will keep you posted as this dispute moves toward a resolution.

UAW To Be In VW Plant By June, Says UAW PrezChloe Morrison of writes that Bob King, the President of the United Auto Workers (UAW), believes that the union will be formally set up at Volkswagen’s Chattanooga plant by the beginning of June.  A spokesperson for the union said that leaders already have union cards from a majority of plant employees, and that talks with Volkswagen over how best to unionize are ongoing.  An election by secret ballot, which would likely be held by the National Labor Relations Board, is also on the table.
