This coming Tuesday, the Senate Health, Education, Labor and Pensions (HELP) Committee will hold a hearing to consider whether the appointment of Sharon Block to the National Labor Relations Board.  The reader may recall that Ms. Block was one of President Obama’s so-called recess appointments, which were held to be Constitutionally unsound by the U.S. Supreme Court earlier this summer.     

If affirmed by the full Senate, Ms. Block will step in to replace current Board member Nancy J. Schiffer, whose term expires in December.  Ms. Block’s confirmation appears likely despite almost certain opposition from Republicans, primarily because of a Senate rule change.  Dubbed the “nuclear option,” Presidential nominations now only need to muster a simple majority of Senate votes to be confirmed.
